Agreement to Terms: These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Kentuckiana Trailer Rental LLC, doing business as Kentuckiana Trailer Rental ("we", "us", or "our"), concerning your access to and use of the www.KentuckianaTrailerRental.com website or landing page, as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and must discontinue use immediately.
Definitions: "Cookie" means a small amount of data generated by a website and saved by your web browser. "Company," "we," "us," or "our" refers to Kentuckiana Trailer Rental. "Country" means the United States, where the owners of Kentuckiana Trailer Rental are based. "Device" means any internet-connected device, such as a phone, tablet, or computer, that can be used to visit Kentuckiana Trailer Rental and use the services. "Service" refers to the service provided by Kentuckiana Trailer Rental. "Website" means Kentuckiana Trailer Rental's site, accessible at www.KentuckianaTrailerRental.com. "You" means a person or entity that is registered with Kentuckiana Trailer Rental.
Services Offered: The Site offers the rental of trailers. Rentals are non-refundable and cannot be returned for a refund.
Deposits: A deposit may be required to reserve a trailer. Deposits will be returned if the trailer is returned without damage.
Damage: You are responsible for any damage to the trailer during the rental period.
Availability: Trailers are available on a first-come, first-served basis and subject to availability. The Site does not guarantee the availability of any specific trailer.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Site is located.
Entire Agreement: This agreement constitutes the entire agreement between you and the Site and supersedes all prior agreements and understandings, whether written or oral, regarding the use of the Site.
Messaging Program Description: We may send promotional and transactional mobile messages in various formats through the Program. Promotional messages advertise and promote our products and services and may include promotions, specials, other marketing offers, and abandoned-checkout reminders. Transactional messages relate to existing or ongoing order notifications and updates, and appointment reminders. Mobile messages may be sent using automated technology. Message frequency will vary but will not exceed 20 messages per month. We do not charge for mobile messages sent through the Program, but you are responsible for any message and data rates imposed by your mobile provider, as standard data and message rates may apply for SMS and MMS alerts.
User Opt-In: By providing your mobile phone number to us, you are voluntarily opting into the Program and you agree to receive recurring mobile messages from us at the mobile phone number associated with your opt-in, even if such number is registered on any state or federal "Do Not Call" list. You represent that any mobile phone number you provide is a valid mobile number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of that number, you agree to promptly notify us at (812) 542-5096. Your participation in the Program is not required to make any purchase from us and is completely voluntary.
User Opt-Out and Support: You may opt out of the Program at any time. To opt out and stop receiving mobile messages, reply STOP, QUIT, CANCEL, OPT-OUT, and/or UNSUBSCRIBE to any mobile message from us. You may continue to receive messages for a short period while we process your request, and you may receive a one-time opt-out confirmation message. For support, reply HELP to any mobile message from us. We may change the telephone number or short code we use to operate the Program and will notify you of any such change.
Disclaimer of Warranty and Liability: The Program is offered on an "as-is" basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.
Limitation of Liability: The Site shall not be liable for any damages of any kind arising from your use of the Site, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
Modifications: We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Terms at any time. Any such modification will take effect when it is posted to our website.
Termination: The Site reserves the right, in its sole discretion, to terminate or suspend your use of the Site at any time, with or without notice and without liability to you.
By accessing or using the Kentuckiana Trailer Rental website, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this agreement.
